ACCEPTABLE USE POLICY

Responsible use of SKPHost infrastructure

This Acceptable Use Policy (“AUP”) establishes the rules for use of hosting, server, network and related services provided by SKPHost Web Solution (“SKPHost”, “we”, “us”, or “our”). Customers are responsible for ensuring that their use of SKPHost services, including use by their authorised users, applications and downstream customers, complies with this AUP and applicable law.

Policy relationship: This AUP forms part of the SKPHost Terms & Conditions and is focused specifically on acceptable use, security and abuse handling.
ACCEPTABLE USE POLICY

Acceptable Use & Abuse Standards

Sections 1–31

01

Customer Responsibility

#

1.1Customers are responsible for the websites, applications, files, databases, scripts, emails, media and other content stored, transmitted or operated through their services (“Customer Content”).

1.2Customers are responsible for activity performed through their account, service or credentials by persons they authorise.

1.3Customers must take reasonable measures to secure their websites, applications, accounts and credentials against unauthorised use.

1.4Customers must ensure that software installed or operated by them is used in compliance with applicable law, applicable licences and this AUP.

1.5A Customer must not knowingly permit another person to use an SKPHost service for activity prohibited by this AUP.

1.6Customers operating reseller or multi-user services must take reasonable steps to ensure that their downstream users also comply with this AUP.

02

Compliance With Law

#

2.1SKPHost services must not be used for activities that are unlawful under applicable law.

2.2Customers are responsible for determining whether their Customer Content, business activities and use of a service are lawful for their circumstances and applicable jurisdiction.

2.3The availability of a technical feature or hosting service does not mean that every possible use of that feature is permitted.

03

Prohibited Content and Activities

#

3.1Customers must not knowingly use SKPHost services to host, distribute, facilitate or promote fraudulent schemes, phishing, credential theft, malware, botnet command-and-control activity, unauthorised system access, deliberately distributed stolen credentials, services primarily designed to facilitate unlawful activity, or other content or activity prohibited by applicable law.

04

Child Sexual Abuse and Exploitative Material

#

4.1Child sexual abuse material (CSAM) and sexual exploitation of minors are strictly prohibited.

4.2SKPHost may immediately restrict access to affected services where reasonably necessary upon becoming aware of apparent CSAM or related exploitation.

4.3Relevant information may be preserved or reported where required or permitted by applicable law.

4.4No prior warning is required where immediate action is reasonably necessary to protect a child, preserve evidence, comply with law or prevent continued distribution.

05

Malware and Malicious Software

#

5.1Customers must not knowingly distribute viruses, ransomware, trojans, worms or other malicious software through SKPHost services.

5.2Customers must not operate malicious command-and-control infrastructure, deliver malicious payloads, steal credentials, compromise third-party systems without authorisation, or operate software primarily intended to damage, disrupt or obtain unauthorised access to another system.

5.3A compromised Customer website or account may be temporarily isolated or restricted where reasonably necessary to protect the affected Customer, SKPHost infrastructure or third parties.

06

Phishing, Fraud and Impersonation

#

6.1Customers must not knowingly use SKPHost services for phishing pages, credential-harvesting websites, payment or financial fraud, deliberately deceptive impersonation intended to facilitate fraud, fake login pages intended to obtain another person’s credentials, or other intentionally fraudulent schemes.

6.2SKPHost may request verification or supporting information where reasonably necessary to investigate suspected fraud.

07

Network Abuse and Unauthorised Access

#

7.1Customers must not intentionally gain unauthorised access to another system, server, network or account; exploit vulnerabilities without authorisation; perform malicious network scanning; conduct password attacks or credential stuffing; circumvent authentication or access controls; intercept communications without lawful authority; or compromise third-party infrastructure.

7.2Legitimate security testing is permitted only where the Customer has appropriate authorisation and the activity does not materially interfere with SKPHost infrastructure or other users.

08

DDoS and Disruptive Activity

#

8.1Customers must not intentionally launch, coordinate or facilitate denial-of-service or distributed denial-of-service attacks.

8.2Customers must not knowingly operate attack infrastructure through SKPHost services.

8.3If a Customer service becomes the source or target of activity that materially threatens network stability, SKPHost may apply reasonable protective measures, including traffic filtering, rate limiting, temporary isolation, null-routing or temporary service restriction where reasonably necessary.

09

Email, Spam and Messaging Abuse

#

9.1Customers must not knowingly use SKPHost services to send unsolicited bulk email in violation of applicable requirements, phishing messages, malware-containing email, messages using forged or materially deceptive sender information, or campaigns that generate excessive complaints, blocklisting or network abuse.

9.2Customers operating mailing systems are responsible for maintaining appropriate mailing practices, recipient permissions where required, and reasonable security against unauthorised relay or account compromise.

10

Resource and Infrastructure Abuse

#

10.1Customers must not intentionally use a service in a manner that materially disrupts infrastructure or other Customers beyond the resources reasonably available to the purchased service.

10.2Prohibited abuse may include processes intentionally designed to exhaust shared resources, excessive automated requests that materially degrade shared infrastructure, deliberate circumvention of resource controls, sustained unreasonable impact on shared CPU, memory, storage, I/O or network resources, or workloads materially inconsistent with the technical limits of the purchased service.

10.3Normal legitimate usage is not a violation merely because it consumes resources. Where possible and appropriate, SKPHost may request corrective action before applying restrictions.

11

Shared and Reseller Hosting

#

11.1Shared and reseller hosting environments share infrastructure among multiple users.

11.2Customers must not intentionally operate workloads that materially impair service for other users.

11.3“Unmetered” bandwidth or another unmetered feature does not mean unlimited CPU, RAM, disk I/O, processes or other finite infrastructure resources.

11.4Resource controls may be applied where reasonably necessary to preserve shared-platform stability.

12

VPS and Dedicated Servers

#

12.1VPS and Dedicated Server Customers generally have greater control over their server environment and are correspondingly responsible for software and workloads they install or operate.

12.2Customers must maintain reasonable security for Customer-managed server environments.

12.3An unmanaged server does not make SKPHost responsible for Customer-installed applications, operating-system configuration or Customer-created security vulnerabilities.

12.4The greater technical control available with a VPS or Dedicated Server does not permit activity prohibited by this AUP.

13

Resellers and Downstream Customers

#

13.1Resellers are responsible for maintaining reasonable controls over accounts they create or manage through their reseller service.

13.2A reseller must not knowingly permit a downstream Customer to continue prohibited activity after becoming aware of it.

13.3Where abuse originates from a downstream account, SKPHost may request that the reseller investigate, disable or otherwise address the affected account.

13.4SKPHost may directly restrict an affected downstream service where reasonably necessary to address an immediate security, legal or infrastructure risk.

13.5A reseller is responsible for representations and services independently offered by the reseller to its own customers.

14

Copyright and Intellectual Property

#

14.1Customers are responsible for ensuring that Customer Content does not unlawfully infringe third-party intellectual-property rights.

14.2SKPHost may review properly submitted copyright or intellectual-property complaints and may request relevant information from the complainant or Customer.

14.3Receipt of a complaint does not automatically establish that infringement has occurred.

14.4SKPHost may take reasonable action where required by applicable law or where sufficiently reliable evidence establishes a policy violation.

14.5Customers may be given an opportunity to respond where appropriate and legally permitted.

15

Music, Media and FFmpeg Hosting

#

15.1Music websites, media-processing applications and FFmpeg-related workloads may be hosted where supported by the applicable SKPHost service.

15.2Customers remain responsible for ensuring that media they upload, process, stream, download, convert or distribute may lawfully be used for the intended purpose.

15.3Availability of FFmpeg, yt-dlp or another technical tool does not grant rights to copyrighted material and does not authorise infringement of third-party rights.

15.4SKPHost does not determine ownership or licensing rights merely from the technical ability of a service to process particular media.

16

File Hosting and Public Downloads

#

16.1File storage or public downloads may be permitted where supported by the purchased service and used lawfully.

16.2Customers must not knowingly distribute malware, unlawfully obtained data or content prohibited by this AUP.

16.3Large-scale file distribution that materially affects shared infrastructure may be subject to the technical limits applicable to the service.

17

Cryptocurrency and Intensive Computing

#

17.1Cryptocurrency mining or similarly intensive computing workloads are not automatically permitted merely because a Customer has access to server resources.

17.2Such workloads may be restricted where prohibited by the applicable service, infrastructure provider or technical limitations.

17.3Unauthorised mining performed through a compromised account or server may be stopped immediately.

17.4Customers should confirm suitability with SKPHost before operating unusually resource-intensive workloads.

18

Proxy, VPN, Tor and Traffic Relay Services

#

18.1Proxy, VPN, Tor or other traffic-relay services are not automatically permitted on every SKPHost product.

18.2Availability depends on the applicable service, network and upstream-provider requirements.

18.3Such services must not be used to facilitate activity prohibited by this AUP.

18.4Customers should confirm service suitability before deploying a public proxy, VPN, exit node or similar traffic-relay service.

19

Adult Content

#

19.1Adult content is not automatically permitted on every SKPHost service.

19.2Where a particular service permits lawful adult content, the Customer remains responsible for compliance with applicable law, age-related requirements and third-party rights.

19.3Any sexual content involving minors, exploitation, non-consensual intimate material where prohibited by law, or other unlawful sexual content is prohibited.

19.4Customers should confirm whether their specific service permits adult content before hosting it.

20

Compromised Accounts and Services

#

20.1A Customer may not always intentionally cause abusive activity. Websites, applications or servers can be compromised by third parties.

20.2Where SKPHost reasonably believes a service has been compromised, SKPHost may temporarily restrict the affected component where necessary to stop ongoing harm.

20.3Customers may be required to remove malware, reset credentials, patch software or take other reasonable corrective measures before normal access is restored.

20.4A compromised account will be evaluated according to the circumstances and will not automatically be treated as intentional abuse by the Customer.

21

Abuse Reports

#

21.1SKPHost may receive reports concerning Customer Content or activity hosted through its services.

21.2An abuse report does not automatically establish that a violation has occurred.

21.3SKPHost may consider the nature of the complaint, technical evidence, server or network information, Customer response, repeated reports, applicable law and any immediate security or safety risk.

21.4SKPHost may request additional information where a report is incomplete or cannot reasonably be verified.

22

False or Abusive Reports

#

22.1Abuse reporting mechanisms must not knowingly be used to submit false, fabricated or malicious complaints.

22.2SKPHost may disregard reports that lack sufficient information to identify the affected service or alleged violation.

22.3Repeated intentionally false reports may be restricted where reasonably necessary to protect the integrity of the abuse process. This does not prevent a person from making a good-faith report that ultimately proves incorrect.

23

Investigation and Customer Cooperation

#

23.1SKPHost may investigate suspected violations of this AUP where reasonably necessary.

23.2SKPHost may request relevant information or corrective action from the Customer.

23.3Customers should reasonably cooperate with legitimate security or abuse investigations relating to their service.

23.4SKPHost is not required to disclose information that would compromise another Customer’s privacy, security systems, confidential information or an active lawful investigation.

24

Enforcement

#

24.1SKPHost will generally seek to use measures proportionate to the nature and seriousness of the issue.

24.2Depending on the circumstances, action may include notice requesting corrective action, removal or disabling of an affected component, rate limiting or network filtering, temporary isolation, temporary suspension, permanent termination in serious or repeated cases, or preservation or disclosure of information where legally required.

24.3The appropriate response may depend on severity, urgency, recurrence, Customer cooperation and risk to other systems or persons.

25

Immediate Action

#

25.1SKPHost may take immediate protective action without prior notice where reasonably necessary to address child sexual abuse material or exploitation, active phishing or credential theft, active malware distribution, an ongoing DDoS or network attack, a compromised service creating an immediate security threat, fraud creating an immediate material risk, a valid legal requirement requiring immediate action, or activity materially threatening SKPHost infrastructure, other Customers or third parties.

25.2Where appropriate and legally permitted, SKPHost may communicate the reason for the action to the affected Customer.

26

Repeated Violations

#

26.1Repeated violations may result in progressively stronger action.

26.2A Customer who repeatedly fails to address abuse originating from their service may be subject to restriction or termination in accordance with applicable SKPHost terms.

26.3The history and seriousness of violations may be considered when determining an appropriate response.

27

No Monitoring Obligation

#

27.1SKPHost does not undertake a general obligation to continuously inspect all Customer Content solely because it is hosted on SKPHost infrastructure.

27.2SKPHost may investigate Customer Content or activity when reasonably necessary in response to security signals, abuse reports, support requests, infrastructure risks or legal requirements.

27.3Hosting Customer Content does not by itself mean that SKPHost created, endorsed or approved that content.

28

Third-Party Infrastructure

#

28.1Certain SKPHost services depend on third-party datacenters, networks and infrastructure providers.

28.2Customers must also comply with restrictions that are lawfully applicable to the infrastructure used for their service where those restrictions form part of the applicable service conditions.

28.3An upstream provider may require urgent action concerning abusive traffic or content hosted on its infrastructure.

28.4Where such a request is received, SKPHost may take reasonable action necessary to protect service continuity or comply with applicable obligations, while considering available information concerning the alleged violation.

29

Customer Responsibility for Consequences of Misuse

#

29.1Customers are responsible for consequences directly resulting from their intentional or negligent misuse of SKPHost services, subject to applicable law.

29.2A Customer remains responsible for fees, claims or remediation costs to the extent they are lawfully attributable to that Customer’s prohibited activity.

29.3This section does not transfer responsibility to a Customer for an event caused solely by SKPHost or for liability that applicable law does not permit SKPHost to exclude.

30

Relationship With Other Policies

#

30.1This AUP governs acceptable use of SKPHost services and infrastructure.

30.2General account and service conditions are governed by the Terms & Conditions.

30.3Refund eligibility is governed by the Refund Policy.

30.4Personal-information processing is governed by the Privacy Policy.

30.5Service availability matters are governed by the Service Level Agreement, where applicable.

31

Changes to This AUP

#

31.1SKPHost may update this AUP where reasonably necessary to address changes in services, security threats, infrastructure, abuse patterns or applicable requirements.

31.2The current version will display its latest revision date.

31.3Material changes will be communicated where required by applicable law or the applicable service agreement.
